Newport Harbor

Balboa Island, the Balboa Peninsula and Lido Isle are all in the City of Newport Beach. Rules on docks, seawalls and building can differ by parcel and can change what you can do with a home. This guide covers what to check and who to ask.

Please read this first

No attorney or CPA has reviewed this guide. It is general information, and I can't give legal, tax, lending or financial advice. Rules change and differ by parcel, so check with the City and your own attorney and CPA before you act on anything here.

Piers, seawalls and flood zones

Most waterways in Lower Newport Harbor are tidelands, which the State owns. So a residential pier there generally pays rent to the City. Ask the City for the current rate and how it could change.

A sale can start a pier permit transfer and a City inspection. Ask what that involves and who pays for fixes.

The City has harbor design guidelines on seawall height. Ask the City what applies to yours.

Balboa Island has a seawall replacement project in the City's capital plan. The City's flood page says many harbor seawalls are privately owned. It also warns that high water may top seawalls, so read it before you rely on a flood zone.

Look up a flood zone with the City's address tool or FEMA's Map Service Center.

Short term lodging permits

In City code, short term means 30 days in a row or less. The City caps permits and keeps a waitlist.

Zoning and a unit's history can affect whether it qualifies for a permit. Check any address with the City's search tool, then the CC&Rs, the recorded rules on a property.

A valid permit may transfer at sale. There is a deadline to file the City's form, and missing it can cost you the permit. Ask the City for that deadline before you close. If you buy through an LLC or a trust, ask if the same deadline applies.

A permit with no activity can close under City code, so ask for its tax filings before you count on it.

What you can build

City code sets height, floor area and setbacks by district. Ask the City for your parcel's limits before you count on adding space.

Work near the water can need a coastal development permit, so ask the City first.

Lido Isle's community association has an Architectural Committee that reviews exterior changes, so ask the association too.

Five questions before you write an offer

  1. Will the dock pass the transfer inspection, and who pays for fixes?
  2. What could pier rent become? Ask the City how rent is set and whether a transfer could change it.
  3. How high is the seawall, who owns it, and has water topped it before?
  4. If the numbers need short term income, was the latest permit renewal filed?
  5. What can you really build? Ask the City how parking rules and the flood code could limit a remodel.

Three things to prepare before you list

  1. Walk the dock against the City's plumbing, electrical and structural minimums before any pier transfer.
  2. If you hold a lodging permit, confirm the renewal, the tax filings and the seller form with the City.
  3. Gather any elevation certificate, seawall condition report and flood repair records.

If you are keeping the home

  1. If you hold a lodging permit, check its renewal date with the City.
  2. If you stop renting, ask the City what notice it needs and what happens to the permit.
  3. Find out who owns your seawall, and ask the City if any cost of the Balboa Island project could reach owners.
